Portugal mudou sua lei de cibercrime para proteger pesquisas de segurança de boa-fé e tornar o hacking legal sob condições específicas e rigorosas.

Daniel Cuthbert Identificado uma nova regra no Artigo 8.o-A, chamada “Atos não puníveis devido ao interesse público em cibersegurança”, que isenta de serem ilegais algumas ações que antes eram vistas como acesso ilegal a sistemas ou interceptação de dados.

A isenção se aplica apenas a pesquisadores de segurança que identificam vulnerabilidades para aprimorar a cibersegurança. Para evitar responsabilidade criminal, condições específicas devem ser atendidas:

Em novembro de 2024, Alemanha O Ministério Federal da Justiça propôs um projeto de lei para proteger pesquisadores de segurança que reportam falhas de forma responsável aos fornecedores.

Anteriormente, em maio de 2022, o Departamento de Justiça dos EUA (DOJ) anunciou revisões em suas políticas federais de acusação em relação a violações da Lei de Fraude e Abuso de Computadores (CFAA), adicionando uma isenção para pesquisas de “boa-fé”.

A pesquisa em segurança é reconhecida e autorizada a explorar sistemas, encontrar Vulnerabilidades, e denunciá-los com segurança, sem consequências legais.
